A Marine Corps staff sergeant who led the squad accused of killing two dozen civilians in Haditha, Iraq, will file a lawsuit today in federal court in Washington claiming that Rep. John P. Murtha (D-Pa.) defamed him when the congressman made public comments about the incident earlier this year.

Attorneys for Frank D. Wuterich, 26, argue in court papers that Murtha tarnished the Marine’s reputation by telling news organizations in May that the Marine unit cracked after a roadside bomb killed one of its members and that the troops "killed innocent civilians in cold blood." Murtha also said repeatedly that the incident was covered up.

Murtha argued that the questionable deaths of 24 civilians were indicative of the difficulties and overpowering stress that U.S. troops are facing. The congressman, a former Marine, has been a leading advocate for withdrawing U.S. forces from Iraq.

In the court filing, obtained by The Washington Post, the lawyers say that Murtha made the comments after being briefed by Defense Department officials who "deliberately provided him with inaccurate and false information." Neal A. Puckett and Mark S. Zaid, suing for libel and invasion of privacy, also wrote that Murtha made the comments outside of his official scope as a congressman.

Telephone calls yesterday to Murtha’s office in Washington were referred to his district office in Pennsylvania, and calls there were not returned. A Marine Corps spokesman declined to comment yesterday on the Haditha investigation or the lawsuit.

The suit could have interesting legal ramifications because Wuterich and the other members of his squad have not been charged and have not received any official investigative documentation about the Nov. 19 incident. A Naval Criminal Investigative Service investigation is expected to determine possible charges this summer, said officials familiar with the case.

Zaid said the filing is designed partly to force Murtha to disclose what information he received from the Defense Department and the Marine Corps commandant to form his opinion, essentially trying to speed up the discovery process in a potential criminal trial.

"This case is not about money; it’s about clearing Frank Wuterich’s name, and part of that is to identify where these leaks are coming from," Zaid said in an interview. "Congressman Murtha has created this atmosphere that has already concluded guilt. He’s created this environment that really smells, and he’s the only one who has done that."

The move by Wuterich is rare, as statements made by members of Congress generally are protected under the "speech or debate" clause in Article I, Section 6, of the Constitution. But legal experts said the clause grants immunity only for what lawmakers say in legislative proceedings and does not apply to news releases, speeches and other public comments.

Rodney A. Smolla, dean of the University of Richmond Law School and a libel expert, said yesterday that Wuterich would have the burden of proving that he is innocent and that Murtha’s statements were false, but he added that the quotations appear to be actionable in court. He said the suit shows that Wuterich probably thinks he did nothing wrong.

"Part of the subtext of this is it’s a showing of confidence and a preemptive strike of sorts," Smolla said. "The congressman’s statement does not sound as if it is merely hyperbole or opinion or name-calling. Instead, it conveys the idea that the Marines violated professional standards and perhaps the law."

Wuterich, through his attorneys, has maintained his innocence and has said that the Marines killed two dozen people that day because they were engaged in a firefight with suspected insurgents. He told his lawyers that he and other Marines used grenades and rifles to clear two houses they thought were hostile. Another Marine’s detailed account of the incident, obtained by The Post, corroborates Wuterich’s version.

Donald Ritchie, associate historian in the Senate Historical Office, said that such defamation suits happen from time to time but that they tend not to go anywhere because of the constitutional protections members have. He said the most famous case was in 1979, when the Supreme Court ruled that Sen. William Proxmire (D-Wis.) was not protected when he made defamatory statements to constituents in a newsletter.

"The Supreme Court has suggested that speech and debate has limits to it, and that makes people vulnerable in certain areas," Ritchie said.

    Apparently the investigation is over and the Navy expects to file charges against some of the Marines involved. Most disturbing though is that CNN is still calling the killings murder when there has been no verdict saying that someone is guilty.

    One thing that burns me is how the MSM behave as though just simply being a vet makes Man-Pig some kind of infallible oracle on military and foreign policy matters and protects him from ever having to justify or explain himself. Jeez, Marshall Pétain was a war hero too but his foreign policy ideas weren’t too sound, were they? And the bar at the American Legion back in my hometown is full of vets with plenty of cranky opinions and nobody puts them on CNN or Meet the Press. It wouldn’t be a bad thing if they did.

    SG - my thought after I heard this - just to deflect from the Murtha suit and to remind the ’stupid’ masses that the Marines are ‘cold-blooded’ killers.

    The ‘incident’ which the bodies weren’t allowed to be exhumed was the one of the Army soldier accused of rape and murder. Don’t want anyone to know that the ‘burned’ up bodies weren’t burned up, that the main victim was indeed 20 years old not the 15 or 14 being claimed in the msm, that possibly (more likely probably) rape never occurred, or that the victims were bound and shot in the head which is an insurgent/Iraqi method - not an American. BTW, if Ms Abeer had been raped, let us not forget that islam punishment for Ms Abeer would have been death at their hands - why the outrage?

    BTW, there have been 6 of these ‘incidents’ - # 1 LT. Ilario Pantano was acquitted of intentionally killing two Iraqis. Did you see this in the msm??? #2 Spc. Nathan B. Lynn was not charged in an ‘incident’ where he was accused of killing an unarmed Iraqi civilian Feb. 15 near Ramadi. Have you seen this in the msm? No why not, could it be - gasp - bias?

    Yep, it is nothing but our one party media’s way of getting the embarrassing story of the defamation lawsuit off the front page. (Not that most of them even bothered to cover it.)

    The AP article says absolutely nothing new. It doesn’t contain a single quote. And it is from anonymous sources.

    It also once again claims that there is a parallel investigation going on regarding a cover up within the chain of command.

    How many times is that going to be investigated? Last I head, that investigation was done and the finding was there was no cover up.

    But the media will tell any lie to protect their spokesmen, like Murtha.

    Imagine my surprise as my browser opened this morning with the following headline: “Source: Evidence Implicates Marines – probe indicates Marines shot Haditha civilians on purpose. Investigators reportedly finish initial review in deaths of 24 civilians.” Underneath the headline is a photograph showing a long row of bodies tied up in winding sheets.

    Now, my browser’s news is provided by MSNBC, so I knew better than to believe it. When I clicked on the hypertext, I went to the same AP article mathews posted - just a rehash of what’s already known, plus the dramatic news that the military investigators have concluded the fact-finding portion of their investigation. There’s NOTHING in the story to justify the headline, or even to make it front-page news.

    When I came to S&L, of course, I saw this story, and everything became clear. But I still couldn’t figure out why this story – which is incredibly more significant than the one MSNBC ran with – wasn’t even mentioned by the MSM, so I went back to the article. Then, I saw it – toward the bottom of the article is a set of hyperlinks for related stories, one of which reads “Marine in Haditha case to sue Rep. Murtha”. I think that’s what’s called in journalistic circles as a “Safe Burial”.

    I’m so used to media bias by now, I come to expect it. But what kills me is that these dinks have the audacity to look innocent and ask “what media bias?” whenever they’re called on it.

    BTW – speaking of “Safe Burial”, the bodies were refused exhumation as suek mentioned (although the press is still calling this “Islamic burial rites”, despite the number of times you’ve debunked that claim, SG). I’M NO LAWYER, but I think this may actually work out in the Marines’ favor. ‘Lack of evidence’ (if you’re a stickler for that sort of thing) will probably not by itself exonerate them, but it will be considerably harder to convict them.

    Just in case there _was_ an exhumation, I googled for “haditha + exhume”, and came up with a number of hits - one of which was a s&l article. The most recent one I’ve found so far was dated 7/11(see below if you’re interested), and says exhumation has not been allowed. I may check out a few more, but that’s fairly recent. Most of the articles seemed to be quotes of the WaPo article.
    Hearings may be a good thing - don’t know how else they can clear the accusations without getting a complete hearing.

    BTW, I do wish Man Pig would stop pretending, as he does again in his latest statement, that he does what he does because he cares so much about the troops. Telling people that, basically, “You suck, you mad dog killers” is an odd way to show your love and affection.

    WASHINGTON (Reuters) - A U.S. lawmaker apologized on Tuesday to U.S. Marines under investigation in the deaths of two dozen Iraqi civilians in Haditha in a statement his office said spared him from a libel lawsuit.

    Minnesota Republican Rep. John Kline, a retired Marine Corps colonel, issued a three-paragraph statement under a deal with lawyers for Staff Sgt. Frank Wuterich, one of the Marines under investigation.

    Wuterich’s lawyers filed a libel lawsuit against another congressman, Democratic Rep. John Murtha of Pennsylvania, on August 2 following his comments on the case.

    “Some news outlets have promoted incomplete statements attributed to me that gave the false impression that I have concluded those involved committed unlawful acts,” Kline said in the statement provided by his office.

    “I am, of course, very concerned regarding any allegations surrounding misconduct by U.S. troops in Iraq. Such allegations must be taken seriously, but we should never rush to judgment before all the facts are known and the military criminal justice process is completed,” Kline said.

    Kline added, “I want to express my sincere apology” to the Marines in the unit that was in Haditha last November 19.

    Wuterich and several other Marines are suspected, but have not been charged, in the killing of two dozen unarmed civilians in Haditha, one of a series of incidents in which U.S. troops are suspected of killing Iraqi civilians.

    Troy Young, Kline’s spokesman, said the statement stemmed from an agreement avoiding a libel suit by Wuterich. Mark Zaid, a lawyer for Wuterich, said “we are completely satisfied” with Kline’s statement.

    Kline has been quoted as saying the allegations indicated the killings were “not an accident. This was direct fire by Marines at civilians.” But Young said Kline “never accused these Marines of being guilty in this incident.”

    Murtha, a decorated Vietnam War veteran and leading Iraq war critic, said in May of the Haditha incident: “Our troops overreacted because of the pressure on them and they killed innocent civilians in cold blood.”

    Lt. Gen. James Mattis, the new top Marine general in U.S. Central Command, is expected to decide whether to bring criminal charges against any of the Marines under investigation.
